Acceptance The Use Of Computer Concepts Terms and Conditions

Your access to and use of Computer Concepts is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.

Orders

An order is not binding upon Computer Concepts until it is accepted; Computer Concepts must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card, or some other method prearranged with Computer Concepts. You agree to pay the amount(s) due as specified on the invoice, and you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.

Shipping Charges

Your total cost for purchase of any product will include the shipping and handling charges shown on your Computer Concepts invoice. However, your original shipping fees are non-refundable in the case of a returned product. Those fees are paid for the services provided by and to the original carrier, and will not be refunded to you if your item is returned for a refund to Computer Concepts.

Credit card details

Computer Concepts accepts most major credit cards for purchases of goods and services. Computer Concepts processes credit cards through Authorize.net. Computer Concepts does not retain any Customer credit card information after an order is placed.

Advice

The contents of Computer Concepts website do not constitute advice and should not be relied upon in making or refraining from making, any decision.

Change of Use

Computer Concepts reserves the right to:

  • change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that Computer Concepts shall not be liable to you for any such change or removal and.
  • change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.

Links to Third Party Websites

Computer Concepts Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

All copyright, trade marks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Computer Concepts or otherwise used by Computer Concepts as permitted by law. In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.

Disclaimers and Limitation of Liability

The Website is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. To the extent permitted by law, Computer Concepts will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website. Computer Concepts makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive. Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of Computer Concepts for death or personal injury as a result of the negligence of Computer Concepts or that of its employees or agents.

Indemnity

You agree to indemnify and hold Computer Concepts and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Computer Concepts arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.

Severance

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

Governing Law

Any dispute arising out of or related to these Terms and Conditions or the sales transaction between Computer Concepts and Customer shall be governed by the laws of the Commonwealth of Virginia, without regard to its conflicts of law rules. Computer Concepts and Customer consent to the exclusive jurisdiction and the exclusive venue of the Williamsburg-James City County General District Court of the Commonwealth of Virginia, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against Computer COncepts that is more than one year after the date of the applicable invoice.

Purchase Agreement

By accepting delivery of any product ordered from Computer Concepts and MyComputerConcepts.com, you (“Customer”) agree to be bound by the terms and conditions listed below. You and Computer Concepts agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and Computer Concepts. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice. Therefore, please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from Computer Concepts.

Sales Tax

Sales tax is only required for orders shipping into states where we have or may have nexus for state tax purposes under applicable laws. Therefore all orders shipping into Virginia will be charged applicable sales tax according to your area’s tax rate.

Return Policy

All merchandise unless otherwise indicated may be returned within 30 days from the original invoice date for a refund. A return authorization number is required for all returns. These terms apply to all refunds. Most products are shipped with a refund/replacement guarantee period unless otherwise noted in the product listing. Customers must inform Computer Concepts of any order discrepancy within 7 days from the invoice date so that we may investigate and resolve the situation accordingly.

A 15% restocking fee will be applied to all returns for refund. Shipping charges are non-refundable. No refunds after 30 days.

Processing Time

You can expect your order to be processed within approximately 24-48 hours, provided the items are in stock and there are no problems with payment verification. Computer Concepts does not guarantee same day-shipping. Orders are not processed on weekends and holidays.

Product Return Procedure

  • To return a product in compliance with Computer Concepts return policy, you must obtain a Return Merchandise Authorization (“RMA”) number within the guarantee return period for the product (described above). To obtain an RMA number, contact Computer Concepts by phone at 757-564-3996. Computer Concepts will not accept returns without prior authorization and a RMA number. Once issued, RMA numbers are valid for 15 days within which return products must be received by Computer Concepts. RMA numbers will not be extended or reissued. Customer should prominently display the RMA number(s) on the shipping label of boxes containing the returned product.
  • Customer is solely responsible for shipping any returned product to Computer Concepts. Customer agrees to use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment. Customer agrees to bear all shipping and insurance charges and all risk of loss for the return product during shipment. Customer agrees that all returned products will be 100% complete, in re-saleable condition, and will include the original packaging material, manuals, blank warranty cards, and other accessories provided by the manufacturer. If any component of the returned product is missing, Computer Concepts Return Procedure will be breached and Computer Concepts may in its sole and absolute discretion reject the entire return or choose to impose additional charges against the customer for replacement of the missing component(s).
  • Computer Concepts will not refund to Customer the original shipping charges. In addition, Computer Concepts will assess a 15% restocking fee against the Customer’s account on all returns for refund.

Warranties; All Product Sold “AS-IS” or “With All Faults”

Computer Concepts is a distributor only. Products sold by Computer Concepts are not manufactured by Computer Concepts. The products may, however be covered by each manufacturer’s warranty  service and support policy (if present). Computer Concepts assigns and passed through to the Customer any warranty of the manufacturer, and customer acknowledges that it shall have recourse only under such warranties and only as against the manufacturer of the products. Computer Concepts makes no representation or express warranty with respect to the product except those stated in this document. Computer Concepts disclaims all other warranties, express or implied, as to any such product, including and without limitation, the implied warranties of merchantablility an fitness for a particular purpose, and any implied warranties arising from statue, trade usage, course of dealing, or couse of performance.

All items sold through Computer Concepts are sold “As-Is” or “With All Faults”. The entire risk as to the quality and performance of these items is with the buyer. Should any of these items prove defective, fo not function, or function improperly in any way following their purchase, the buyer, and not the manufacturer, distributor, or Computer Concepts, assumes the entire cost of all necessary servicing or repair.

3-Year Extended Warranty on New Computers

In some cases, Computer Concepts affixes a 3-year warranty to  new computer products and extends this warranty to the Customer. If a product is stated to have this warranty, all warranty claims shall be handled through Computer Concepts. During the first year of ownership of the product, Computer Concepts will act on behalf of the Customer to resolve warranty claims through the manufacturer of the product and will notify Customer of the status of such warranty claims throughout the warranty claim process. During the second and third year of ownership of the product, Computer Concepts becomes responsible for addressing warranty claims and will work to resolve issues that arrise. To pursue a warranty claim on a product sold through Computer Concepts with a 3-year warranty, you must contact Computer Concepts at 757-564-3996. Computer Concepts will communicate the procedure for processing a claim with Customer at the time a claim is submitted. Computer Concepts will communicate with Customer throughout the warranty claim process about the status of the warranty claim.
